Terms of Service

Effective Date: April 1, 2026

These Terms of Service ("Terms") govern your access to and use of E:DA (잇다) ("Service"), a community-based attendance and group management platform operated by fivehours ("Company," "we," "us," or "our").

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.


1. Purpose

These Terms establish the conditions and procedures for using the Service, as well as the rights, obligations, and responsibilities between the Company and users.


2. Definitions

  1. "Service": The community-based attendance and group management platform provided by the Company under the brand "E:DA (잇다)," including all related features and services.
  2. "User": Any individual who agrees to these Terms and uses the Service.
  3. "Group": A community created within the Service (e.g., classes, clubs, study groups, organizations).
  4. "Owner": The user who created a Group and holds the highest administrative authority over it.
  5. "Admin": A user who has been granted administrative privileges by the Owner within a Group.
  6. "Member": A user who has joined a Group.
  7. "Event": An individual activity created within a Group (e.g., class session, meeting, study session).
  8. "Attendance Check": The act of recording participation in an Event, categorized as present, late, absent, or excused.
  9. "Post": Any content created by a user within the Service, including articles, comments, and images.
  10. "DM (Direct Message)": One-to-one text and image messages exchanged between users.

3. Effectiveness and Modification of Terms

  1. These Terms become effective when posted within the Service or otherwise communicated to users.
  2. The Company may modify these Terms for legitimate reasons, provided such modifications do not violate applicable laws.
  3. When Terms are modified, the Company will announce the changes and effective date at least 7 days in advance through in-app announcements or push notifications. For changes that are unfavorable to users, notice will be provided at least 30 days in advance.
  4. Users who do not agree with the modified Terms may discontinue use of the Service and request account deletion.
  5. Continued use of the Service after the effective date of modified Terms constitutes acceptance of the changes.

4. Account Registration and Termination

Registration

  1. A service agreement is established when a user agrees to these Terms, registers through Google or Apple social login, and the Company accepts the registration.
  2. Users must be at least 14 years of age to register. Persons under 14 years of age may not use the Service.
  3. The Company may refuse or subsequently terminate registration in the following cases:
    • Use of another person's identity or submission of false information
    • Re-registration by a person whose account was previously terminated for violating these Terms
    • Other violations of applicable laws or Company standards

Account Deletion

  1. Users may request account deletion at any time through the app settings.
  2. A 30-day grace period applies after a deletion request, during which the request may be canceled.
  3. After the grace period, the account and personal data will be deleted in accordance with the Privacy Policy.

5. Service Description

The Service provides the following features:

  1. Group Management: Create groups, invite and manage members, approve join requests, manage roles (owner/admin/member), set recurring schedules.
  2. Event Management: Create events (online/offline), manage registrations and cancellations, set maximum capacity.
  3. Attendance Check: QR code-based self check-in, admin-assisted check-in, attendance statistics and reports.
  4. Community Boards: Group-specific boards (announcements, free discussion, etc.), posts, comments, activity feed cards.
  5. Direct Messaging (DM): One-to-one text and image messaging between users with read receipts.
  6. Workout Logs: Record exercise data (type, sets, reps, weight, etc.) for attended events.
  7. Challenges: Create and participate in group challenges, track completion status.
  8. Coach Notes: Individual feedback written by admins for members.
  9. Quizzes: Create and participate in group quizzes.
  10. Membership Passes: Membership passes managed by group admins.
  11. Push Notifications: Attendance reminders, event notifications, DM notifications.
  12. Service Announcements: Platform-wide announcements and updates.

6. Service Availability

  1. The Service is provided 24 hours a day, 7 days a week, as a general rule.
  2. However, the Service may be temporarily suspended in the following cases:
    • Scheduled or emergency maintenance
    • System failures, server upgrades, or other technical issues
    • Force majeure events such as natural disasters, national emergencies, or power outages
  3. The Company will notify users before or after service interruptions through in-app announcements or push notifications.
  4. The Company may modify all or part of the Service for operational or technical reasons, with advance notice provided through in-app announcements.

7. User Obligations

  1. Users must comply with applicable laws, these Terms, service guidelines, and the Community Guidelines.
  2. Users are responsible for maintaining the security of their accounts and may not transfer or lend their accounts to others.
  3. Users must not engage in the following activities:
    • Unauthorized collection or use of other users' personal information
    • Interference with the operation of the Service or damage to its systems
    • Impersonation of other persons or posting of false information
    • Threatening, intimidating, or harassing other users
    • Posting obscene, violent, or illegal content

8. Prohibited Activities

Users are prohibited from the following activities when using the Service:

  1. Hate Speech and Discrimination: Hateful, discriminatory, or derogatory speech based on race, ethnicity, gender, sexual orientation, religion, disability, age, or other protected characteristics.
  2. Harassment and Threats: Repeated harassment, stalking, threats, or intimidation directed at specific users.
  3. Illegal Content: Posting, distributing, or soliciting content that violates applicable laws.
  4. Sexually Explicit Content: Posting pornographic or sexually inappropriate content.
  5. Spam and Advertising: Unsolicited commercial advertising, spam, multi-level marketing, or similar content without user consent.
  6. Impersonation: Impersonating other individuals or organizations, or spreading false information.
  7. Data Scraping: Using automated means (bots, crawlers, etc.) to collect Service data without authorization.
  8. System Abuse: Compromising Service security, exploiting vulnerabilities, or causing excessive load on the Service.
  9. Attendance Fraud: Falsifying attendance records, proxy check-ins (except admin-authorized check-ins), or manipulating attendance data.
  10. Intellectual Property Infringement: Posting content that infringes on the copyrights, trademarks, or other intellectual property rights of others.
  11. Privacy Violations: Disclosing or distributing another person's personal information without their consent.
  12. Other: Any conduct that violates public order, morals, or applicable laws and regulations.

9. Service Use Restrictions

  1. The Company may take the following actions against users who violate these Terms or the Community Guidelines:

  1. The Company will notify the affected user of the reason and details of any action taken via in-app notification or email.
  2. Users may appeal any restriction within 14 days of receiving notice.
  3. The Company will communicate the results of an appeal within 7 business days of receipt.

10. Content Rights and Responsibilities

  1. Users retain copyright ownership of content they post within the Service.
  2. By posting content, users grant the Company a non-exclusive license to use, reproduce, modify, and distribute such content for the purposes of operating, improving, and promoting the Service. This license remains in effect until the user deletes the content or their account.
  3. The Company will not sell user content to third parties without the user's consent.
  4. Users must not post content that infringes on the intellectual property rights of others. Users bear full legal responsibility for any such infringement.
  5. The Company may remove or hide content without prior notice if it:
    • Violates these Terms or Community Guidelines
    • Infringes on the rights of other users or third parties
    • Violates applicable laws
    • Is subject to a request from a competent authority
  6. Upon account deletion, posts and comments may be anonymized. Users who do not wish this should delete their content before requesting account deletion.

11. Intellectual Property

  1. All intellectual property rights in the Service belong to the Company, including the design, logos, trademarks, software, code, and UI/UX.
  2. Users may not reproduce, distribute, modify, reverse-engineer, or commercially exploit any part of the Service without the Company's prior written consent.
  3. All trademarks within the Service ("E:DA," "잇다," "fivehours," etc.) are the property of the Company and may not be used without authorization.

12. Disclaimer of Liability

  1. The Company provides a platform for community-based attendance and group management. Responsibility for the operation of individual Groups and activities within them lies with the respective Owners and Admins.
  2. The Company is not liable for:
    • Service interruptions caused by force majeure events (natural disasters, war, terrorism, pandemics, etc.)
    • Service disruptions or data loss caused by the user's own actions
    • Disputes between users, or between users and third parties
    • Disputes regarding Group operations or activities within Groups
    • The reliability or accuracy of information posted by users within the Service
  3. The Company bears no liability for services provided free of charge, except as required by applicable law.

13. Indemnification

  1. Either party that causes damage to the other by violating these Terms shall be liable for such damage.
  2. The Company's liability may be limited to the extent permitted by applicable law.
  3. Users who cause damage to the Company by violating these Terms (including third-party claims) shall indemnify and hold the Company harmless.

14. Privacy

The Company protects users' personal information in accordance with applicable laws and its Privacy Policy. For details on the collection, use, sharing, and deletion of personal information, please refer to our Privacy Policy.


15. Governing Law and Dispute Resolution

  1. These Terms shall be governed by and construed in accordance with the laws of the Republic of Korea.
  2. Disputes between the Company and users shall be resolved through mutual consultation as a first step.
  3. If consultation fails, the Seoul Central District Court shall have exclusive jurisdiction as the court of first instance.
  4. Users may also seek dispute resolution through the Korea Internet & Security Agency, Personal Information Dispute Mediation Committee, or other applicable regulatory bodies.

Supplementary Provisions

  1. Effective Date: These Terms take effect on April 1, 2026.
